Nurse avoids prison after a head-on crash leaves a man with catastrophic injuries

On December 14, 2020, Kevin Kmiec’s Fiat Diablo collided head-on with Hayley Green’s BMW.  The incident occurred when Green, a 30-year-old nurse from Bronllys, engaged in inappropriate driving behaviour and attempted to overtake another vehicle.  As a result of the crash, Mr Kmiec was trapped in his car until emergency services arrived and freed him. He was subsequently transported to the University Hospital of Wales, Cardiff.

Kevin Kmiec spent 10 days in hospital where he underwent two significant surgeries due to sustaining fractures on both sides of his pelvis, nerve damage, a dislocated and shattered hip, lacerations, and bruises. As a result, Kmiec is still struggling with pain and mobility. Formerly a rugby coach, Mr Kmiec is now being cared for by his wife and family due to his inability to move well. The catastrophic injuries acquired by the car accident have affected his family financially as he has been unable to work, and his wife has been forced to early retirement to look after him.

Although denying a charge of causing serious injury by dangerous driving, Green changed her plea in April. According to the Shropshire Star report, during the proceedings at Merthyr Tydfil Crown Court on Friday, June 9th, it was revealed that the accident occurred as Mr. Kmiec was en route to visit his daughter in Mold.

While navigating a bend on the A483 between Howey and Llandrindod Wells, he encountered a BMW just 50 meters ahead, positioned sideways. Green had failed to maintain control of the vehicle, causing it to slide horizontally across both lanes of the road. As a nurse at Llandrindod Wells Hospital, she was on her way to work when the crash happened. Green was overheard saying “it’s not my fault, I had to get to work’, while also telling people that she had a ‘blackout’ and ‘could not remember anything’. She had been suffering from panic attacks for some time and was prescribed medication for anxiety and depression.

Green’s representative, Mr. Hashim Salman, stated that she had a previously commendable character, and relevant references were presented to the court as part of the mitigation process. She said: “I feel sick that Mr Kmiec is unable to do the things he had been able to previously. I am a nurse and knowing I have hurt someone hurts me, as I am normally the person that helps people.”
