NHS trusts in England have resolved nearly 400 successful claims related to birth injuries leading to cerebral palsy over the past six years, resulting in damages exceeding £1.5 billion, according to disclosed data.
Relatives of infants born with cerebral palsy, often due to failures in delivering the baby when clear indicators were present, filed 397 successful claims during this period. Additionally, NHS trusts settled over 200 claims related to brain damage, paying out more than £800 million in damages over the same timeframe. The third highest category of claims, totalling £145 million in damages, pertained to 42 cases of “wrongful birth.” This legal term refers to a malpractice claim brought by the parents of a child born with a birth defect against a physician or health-care provider whose alleged negligence (as in prenatal testing or diagnosis) effectively deprived the parents of the opportunity to make an informed decision whether to avoid or terminate the pregnancy.
The revealed data underscores a concerning pattern of birth injury-related claims against NHS trusts in England. Over the past six years, successful claims related to cerebral palsy have reached nearly 400, resulting in damages surpassing £1.5 billion. In addition, the 200 settlements for brain damage claims, amounting to over £800 million, further highlight the substantial financial implications for the healthcare system.
The high volume of cases regarding birth injuries emphasises the need for continued advocacy and legal support for families affected by birth injuries. It also underscores the importance of holding healthcare providers accountable to prevent future instances of medical negligence, ensuring justice and compensation for those impacted.
