Relatives of infants born with cerebral palsy, often due to failures in delivering the baby when clear indicators were present, filed 397 successful claims during this period. Additionally, NHS trusts settled over 200 claims related to brain damage, paying out more than £800 million in damages over the same timeframe. The third highest category of claims, totalling £145 million in damages, pertained to 42 cases of “wrongful birth.” This legal term refers to a malpractice claim brought by the parents of a child born with a birth defect against a physician or health-care provider whose alleged negligence (as in prenatal testing or diagnosis) effectively deprived the parents of the opportunity to make an informed decision whether to avoid or terminate the pregnancy.
